Challenge a parking fine

If your formal representations are unsuccessful, we will send a Notice of Rejection of Representations and a Notice of Appeal form to the registered vehicle owner.

To request an appeal you must submit the Notice of Appeal form to the Traffic Penalty Tribunal (TPT).

You must submit your appeal within 28 days of the Notice of Rejection of Representations being delivered.

Making an appeal

You should decide which of the legal grounds of appeal applies to your case. These are listed on the Notice of Appeal and are the same as those listed on a Notice to Owner.

You will also need to choose how your appeal will be decided:

• Postal decision without a hearing
• Telephone hearing
• Face-to-face hearing

You may be able to submit your appeal online to the Traffic Penalty Tribunal (TPT).  If this isn’t available, you will need to return the notice of appeal form by post to the address on the form.

Once the Notice of Appeal form is received by the TPT, some basic checks will be done and the appeal registered.

You will be sent formal acknowledgement that your appeal has been received and registered.

After the Decision

After the adjudicator has made their decision, a letter will be sent to the appellant and the council stating either of the following:

The appeal is upheld and the appellant is not liable to pay the penalty charge.

Or

The appeal is refused and the appellant is liable to pay the penalty charge.

What happens next

If you win your appeal the liability for the penalty charge is cancelled, and this should be the end of the matter.

If you lose your appeal, you must pay the charge due to the council within 28 days of the adjudicator’s written decision. If you fail to do so, the council will be entitled to continue enforcement proceedings against you.
